The House Committee on Justice did not approve Supreme Court Chief Justice Ma. Lourdes Sereno's motion to cross-examine the witnesses against her through her lawyers.

With 30 votes in favor and four against, the House panel chaired by Oriental Mindoro Rep. Reynaldo Umali approved the motion by AKO BICOL partylist Rep. Alfredo Garbin denying Sereno’s motion.

Garbin reminded the lawyers and members of this committee that “we are not sitting here as an impeachment court.”  He was seconded by Majority Leader and Ilocos Norte Rep. Rodolfo Fariñas but was rejected by Siquijor Rep. Rav Rocamora, a former prosecutor.

Fariñas himself was surprised with Sereno’s motion to cross-examine the complainant.

“This (impeachment deliberation) is not akin to criminal proceedings. In the case of Estrada vs Ombudsman case, the Supreme Court held that Senator Estrada does not even have the right to demand copies of the complaint and Chief Justice Sereno concurred with that,” he said.

Even in criminal proceedings, at the preliminary conference stage, when only parties are required to appear...without their counsel...cross examination is conducted in such a way that questions are written on a piece of paper and given to the judge who will ask the questions to the party concerned. Now in this impeachment case since respondent sereno chose not to appear...only her counsel were sent to appear for her, she has set aside her opportunity to defend herself...no one else to blame but herself...
