Granting a quo warranto petition, the case used to ouster the sitting Chief Justice Maria Lourdes Sereno can be also filed against both President and the Vice President of the Philippines on the grounds of an "invalidly elected impeachable official, according to Supreme Court.

In a historic move, the decision of Supreme court ousted Chief Justice Maria Lourdes Sereno over the alleged failure to meet the integrity requirement for members of the judiciary.

In the same proceedings, Supreme Court said that both Philippine President and Vice President may also be removed from office through quo warranto petition written under Presidential Electoral Tribunal (PET) rules.

"Further, the PET Rules provide that a petition for quo warranto, contesting the election of the President or Vice-President on the ground of ineligibility or disloyalty to the Republic of the Philippines, may be filed by any registered voter who has voted in the election concerned within ten days after the proclamation of the winner,"

"Despite disloyalty to the republic being a crime against public order defined and penalized under the penal code, and thus may likewise be treated as 'other high crimes,' constituting an impeachable offense, quo warranto as a remedy to remove the erring President or Vice-President is nevertheless made expressly available," it added.

The government can initiate quo warranto proceedings against a person who “usurps, intrudes into, or unlawfully holds or exercises a public office." According to the rules of the court. 

The quo warranto petition which was initiated by Solicitor General Jose Calida cited Sereno's alleged failure to file her Statement of Assets, Liabilities and Net Worth (SALN) in compliance with the requirements of the Judicial and Bar Council (JBC) when she applied to sit in the office back in the year 2012.

Section 2 Article XI of the Constitution provides that “the President, the Vice-President, the Members of the Supreme Court, the Members of the Constitutional Commissions, and the Ombudsman may be removed from office” by impeachment.  

But impeachment is not the only way to remove some government officials from office, according to the 153-page decision disqualifying appointment of Sereno as chief justice.

Voting 8-6, the SC after its full-court session, granted the quo warranto petition filed by Solicitor General Jose Calida.

that seeks the invalidation of appointment of Sereno to the country's highest judiciary post.

The removal of Sereno thru a quo warranto proceedings has since been condemned by some lawmakers, law professors and law groups who said such mode to oust a Chief Justice is unconstitutional.

President Rodrigo Duterte won the presidency with more than six million votes ahead of second placer Liberal Party candidate Manuel “Mar” Roxas II.

While Vice President Robredo beat her closest rival Sen. Ferdinand “Bongbong” Marcos Jr. by 263,473 votes in a hotly contested vice presidential race. 

VP Robredo is currently fighting an electoral protest which was filed against her by former "Bongbong" Marcos to the Supreme court sitting as the Presidential Electoral Tribunal.

A manual recount of votes in the vice presidential race between Leni Robredo and Ferdinand "Bongbong" Marcos is now on going.
